I attended a seminar by WWICS in July'12 and filled a general form their regarding my work experience and education, after 2-3 days later i got a call from WWICS that i am eligible for Australia PR. For more details i visited their branch office were WWICS executive again assessed my qualification details and told that i have strong chances for Australia state provincial PR program under Accountant category after that i signed a contract with them to file my PR case for which i paid INR55000 and $650 to WWICS (total of around INR93k)after this their executive told me that i need to submit copies of my education and work experience certificate, also a detail of my work profile which their associate company will provide on the basis of my CV. So i provided my CV to executive and he told me that he will sent details to concerned department and Ill get job profile soon after which they will file my case, but didn't get any response from executive for 10-15days so called him to know the status he told me that it will take another 2-3 days and will call me as soon he will receive the same and said the same thing 2-3 times whenever i called him, so i went to their office personally to meet the executive and warned him that I'll withdraw my case if he has this kind of attitude and he assures me that i don't need to worry as WWICS is concerned about their customers and this process is little time consuming, and he will call me as he get job profile point from concerned department.
After this i am also got busy with my work but got worried again when didn't got any call even after 15 days from WWICS executive. So i called their office and receptionist told me that executive is on leave, after 2 days again when i called and inquired about my case status receptionist told me that some other executive is handing my case now So i got little worried and visited their office were i came to know that executive who was handling my case left the company, WWICS never called me and think it is their responsibility to inform me about this. And shocked even more to know when new executive told me that earlier executive didn't done anything on my case so she assures that she will soon start process but same problem again time taken by internal process is so long that even after 5 months of contract they not even filed my case to related Australian immigration authority and later told me that i am not eligible for PR but i told them that what earlier executive told me as per that i am eligible for PR case but now you people are saying that am not eligible. After this i write e-mail to them for withdrawing my case and refund of money paid to WWICS for which i got response after 2 months for rejection of my refund with reason that i have not submitted required documents which is totally rubbish, and visited branch manager for this and he told me that management always done this, and said that he will write to MD of company . But also told me that there are very rare chances of getting refund and got expected response -rejection again by management.
Now i want to file complaint against company to get my hard earned money back and punish them for their act. So i want to know what legal actions i can take against them-1. Do i have to lodge police complaint against company and then go to consumer court or 2) i can go directly to consumer court for refund? , Also money I had paid is INR 55000 in name of WWICS and $650 to GPS (some WWICS related concern) so I have to file 2 separate complaints as 2 parties involved.
Please suggest procedure of taking legal actions.
